Mediation is an efficient, private, and inexpensive alternative to a judicial trial. A mediator does not decide the issues in dispute but rather assists the parties and their lawyers to reach a negotiated settlement. Mediation is so often successful that many courts, including the Superior Court of New Jersey, mandate pre-trial mediation of many lawsuits. Settlement in mediation is entirely voluntary and, even if the matter does not settle, the participants almost always gain a better understanding of the facts, issues, and the other interests involved.
